Nailed is officially back filming, pictures of Jesse on set have shown up - It’s great to see candids.. This year has been really slow for her thus far, but it’s okay, because she’s been filming, which means lots of movies to look forward too!! Be sure to check Jesse out in a rockin’ red dress!

UPDATE: Our comments are now working, and also edited the layout some, changed the main image to pictures of Jesse is just adore.. Let me know your thoughts.

‘Nailed’ dodges bullet with funding deal

David O. Russell’s political comedy “Nailed” will resume filming Wednesday thanks to a late-breaking financing deal with Comerica Bank and the film’s financier, Capitol Films. Key cast members, including Jake Gyllenhaal, Jessica Biel and Catherine Keener, were en route to the South Carolina set Tuesday to begin shooting the next day.

But the ultimate future of the film from the economically troubled Capitol remains uncertain.

Sources say the Comerica financing, secured Monday, will help the film meet its projected $25 million budget and additional costs from a week of missed shooting days and union penalties. But some of the filmmakers aren’t sure if the funds will last through postproduction.

Capitol’s head of business affairs, Ray Reyes, said the company’s fund deal with Comerica was based on “other guarantees” and was closed without a bond.

“We do plan on bonding the film, and actually there’s work to be done on that, under a much more manageable scenario,” Reyes said. “We can hopefully close the bond after we have completed principal photography and without the pressure of shutdowns hanging over our heads.”

‘Nailed’ shooting resumes

“Nailed” is back in production this week in Columbia after its third work union stoppage in a month, but the movie’s producer is facing lawsuits for unpaid bills and loans, a trade publication is reporting.

David Bergstein, who heads “Nailed” backer Capitol Films, has been sued by advertising promoter Allied Advertising for $4.2 million in unpaid bills, Variety reported. This month, businessman Alexander Sandel filed suit against Bergstein and five affiliated production entities over loans totaling more than $4.5 million, Variety reported.

Bergstein did not respond to Variety’s request for comment. Bergstein is expected to close a bridge financing deal soon, the publication reported.

The comedy “Nailed,” starring Jessica Biel and Jake Gyllenhaal, started shooting in mid-April around Columbia. Shooting is scheduled to end in mid-June.

The International Alliance of Theatrical & Stage Employees ordered its members last week to not show up at the set after not being paid. The same union also stopped production a couple of weeks ago after not being paid.

The Screen Actors Guild had ordered its members to walk off the film set early this month because producers failed to deposit enough money in accounts to pay actors.

Forty-six checks for the “Nailed” production bounced due to insufficient funds, according to the film’s bankers quoted by Variety.

Legal pressure on ThinkFilm mounts

The legal heat keeps mounting on David Bergstein, the topper of Capitol Films and ThinkFilm, as Allied Advertising has filed a lawsuit against them alleging $4.2 million in unpaid bills.

Allied, which handles ads and promotions for feature films, filed the suit Wednesday in Los Angeles Superior Court. It accuses Bergstein of racking up $1.9 million in debt as of November and another $2.2 million this year while continuing to spend on acquisitions.

“Between January and May 2008, while most of the ThinkFilm debt to Allied was outstanding, defendants have gone on a lavish film licensing buying spree at various film festivals around the world, including a film about director Roman Polanski scheduled for release on (HBO) later in 2008,” Allied alleges in the suit. “In addition, defendants now pre-pay for print and advertising services and that only for so long as Allied elects to do business with ThinkFilm at all.”

Allied said it sent a final demand for the funds on May 12.

“Notwithstanding these demands, Bergstein has, on information and belief, directed ThinkFilm to simply ignore the demands of Allied,” it added. “Neither ThinkFilm nor Bergstein have ever disputed the obligation to pay the $4.185 million due and owing to Allied.”

‘Nailed’ production shut down again

Production of troubled indie comedy “Nailed,” starring Jessica Biel and Jake Gyllenhaal, has been shut down for a third time due to financial problems.

Below-the-line crews refused to work Thursday. Members of the Intl. Alliance of Theatrical & Stage Employees were ordered by IATSE leaders not to show up at the South Carolina set after not being paid.

A person familiar with the situation said production’s expected to resume next Thursday in South Carolina. Previously set plans had been for filming to go on to a Thursday-through-Monday work week at that point to accommodate the availability of locations such as the state capitol buildings.

IATSE-repped employees also stopped production on May 15 after not being paid, then resumed on Monday. The Screen Actors Guild had ordered its members to stop working on May 9 after film financer Capitol Films failed to deposit enough required money in SAG accounts set up to pay the actors. Filming then resumed on May 12 after the funds went into the accounts.

Capitol Films was not immediately available for comment. IATSE also would not comment.

Pic, directed by David O. Russell, began shooting April 15 and is due to wrap in mid-June. Catherine Keener, James Marsden and Tracy Morgan also star.

In a previous interview, Capitol Films topper David Bergstein insisted his company was on firm financial footing despite reports about unpaid bills and lawsuits.

“Nailed” is produced by Douglas Wick and Lucy Fisher through their Red Wagon banner and by Persistent Entertainment. Script by Russell and Kristin Gore, centers on an uninsured woman who goes on a crusade for better health care after a nail is accidentally shot into her head.
